October 23, 2009- Monmouth County drivers need to be alert that a task force from Monmouth County will be performing a DWI roadblock in Manalapan and a DWI checkpoint (checkpoint & roadblock are used interchangeably) in Union Beach  this weekend to procure whether drivers are operating under the influence of drugs and/or alcohol. Those suspected of intoxication or being under the influence, will be arrested for DWI.

The checkpoint in Manalapan will be in effect from11:00 p.m. tonight to 3:00 a.m. Saturday on Route 9 in Manalapan. The police will be looking to arrest violators and charge them with a Manalapan DWI. They will direct vehicles from the southern lanes into the Sun Bank parking lot to determine drivers' sobriety.The second checkpoint will be in effect from 11:00 p.m. Saturday until 3:00 a.m. Sunday on Route 36 in Union Beach. All accused will be charged with a Union Beach DWI. They will order vehicles from the western lanes into the Holy Family Church parking lot to check sobriety.

May 15, 2009-WEST LONG BRANCH — A DWI task force from Monmouth County will be on the hunt for drunk drivers in West Long Branch this evening. The DWI checkpoint or drunk driving roadblock will be in existence from 11:00 p.m. tonight until 3:00 a.m. Saturday along Route 36. The task force and officers from the West Long Branch Police Department will direct vehicles from the westbound lanes into the Monmouth Park Corporate Center parking lot.
 

Now that summer is almost upon us, you can expect to be subject to DWI roadblocks pretty much every Friday night. The United States Supreme Court has held that these roadblocks are Constitutionally legal provided the police follow certain required mandates. Deal, NJ- A task force from Monmouth County and Deal Police will perform a sobriety checkpoint tonight to determine whether drivers are under the influence of alcohol and/or drugs. Anyone who is, will be charged with DWI, N.J.S.A. 39:4-50. It will begin at 11:00 p.m. tonight and continue through 3:00 a.m. Saturday on Ocean Avenue. The unit will direct  vehicles from the northbound lanes into the Deal Casino Beach Club parking lot to check drivers' sobriety.

HOWELL — A DWI task  force will perform a DWI checkpoint tonight to detect drivers under the influence of drugs and/or alcohol. The task force checkpoint will run from 11:00 p.m. today until 3:00 a.m. tomorrow on Route 9 South. The task force members along with Howell police officers will direct vehicles from the southbound lanes into the Regal Plaza parking lot to determine drivers' sobriety.

FAIR HAVEN —  A DWI Task force from Monmouth County will perform a checkpoint beginning Friday evening in an attempt to detect drivers who are driving while intoxicated as the result of alcohol or drugs. The roadblock will run from 11:00 p.m. today until through 3:00 a.m. Saturday. Officers will be lloking to arrest individuals for N.J.S.A. 39:4-50 (DWI) along River Road. The task force officers and Fair Haven police will direct vehicles from the eastbound lanes of River Road into the Acme Markets parking lot to check drivers' sobriety.

HOLMDEL — A County DWI task force will execute a roadblock and/or checkpoint tonight to determine if drivers are operating under the influence of alcohol or drugs. The checkpoint will be conducted from 11:)0 p.m.  tonight through 3:00 a.m. Saturday along Route 35 South. Memebers from the task force and police from Holmdel will steer vehicles from the southbound lanes into the Dearborn Farms and Garden Center parking lot to determine drivers' sobriety.

Asbury Park — Law Enforcement Officers who compose the DWi task force in Monmouth County will hold a checkpoint tonight to stop and arrest drivers under the influence of alcohol and/or drugs.

The time of the roadblock will be from 11:00 p.m. tonight through 3:00 a.m. on Saturday, August 2, 2008 along the southbound lanes of Main Street. The task force officers and Asbury Park police officers will stop cars, trucks and buses from aforementioned lanes into the Asbury Municipal Complex to ensure the driver's sobriety.

Many people who are charged with DWI as a result of the roadblock or checkpoint are often uncertain as to its validity or legality. If you are charged with DWI and/or refusal to submit to a breathalyser or alcotest examination, you should consult an experienced DWI or Criminal lawyer to check whether the police followed the mandatory guidelines associated with these stops. In order to ensure that the roadblocks are legal, New Jersey has promulgated technical guidelines to prevent against unreasonable detention and arrests arising from roadblocks.

The United States Supreme Court first addressed the Constitutionality of police roadblocks in the 1979 case of Delaware v. Prouse, 440 U.S. 648 (1979). In Prouse, the Court ruled that it was unconstitutional to stop and detain a driver absent a reasonable and articulable suspicion that the driver is unlicensed, that the car is not registered, or the car or occupant is subject to arrest for violation of law (e.g. motor vehicle violation, warrant, etc.).

Under New Jersey Law, the Appellate Division, visited this issue in the case of  State v. Kirk, 202 N.J. Super 28 (App.Div.1985). In Kirk, the court ruled that checkpoints/road blocks administered by law enforcement are unconstitutional absent safeguards and procedures for ensuring supervisory control of checkpoints and advanced notice to motorists of the pending roadblock. By way of example, in State v. Moskal, 246 N.J. Super 12 (1991) the mandatory procedures must be in effect if the roadblock and subsequent DWI and/or refusal charges are to be sustained.

There are a litany of factors that must also be considered by a Court in determining the validity of a roadblock, as per State v. Kirk, infra. In light of these mandatory requirements, which must be adhered to by police in conducting a roadblock, an experienced and intelligent DWI lawyer is necessary in defending a DWI roadblock case. A DWI/DUI a.k.a. N.J.S.A. 39:4-50 (driving while intoxicated) task force from Monmouth County will perform a roadside checkpoint tonight to detect drivers under the influence of alcohol and or drugs. The hours of operation for the checkpoint will be between 11 p.m. through 3 a.m. Saturday on Main Street.

Officers from the task force and Avon will pull vehicles from the southbound lanes onto Garfield Avenue to determine drivers' sobriety. If you are arrested as a result, you should contact an experienced attorney who can advise you as to whether the task force followed the necessary guidelines required for a valid checkpoint.
